To use some of the services or features made available to you on this Site you will need to register. When you register you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately at the following e-mail address customerservice@mimiamo.com. We may also change registration requirements from time to time.

The account password you provide should be unique and kept secure, and you must notify Mimiamo immediately of any breach of security or unauthorized use of your account. Although Mimiamo will not be liable for your losses caused by any unauthorized use of your account, you may be liable for Mimiamo's losses or others due to such unauthorized use.

3. ELIGIBILITY TO PURCHASE

The purchase of merchandise through the Mimiamo Co., Ltd. is strictly limited to parties who can lawfully enter into and form contracts on the Internet in accordance to the conditions set forth in these terms and conditions, is that of the regulation on distance selling, pursuant, in particular, to the Consumer Code, as well as the specific provisions set forth below.

In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet the Mimiamo’s terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to Mimiamo, and who have authorized Mimiamo to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, Mimiamo reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

By making an offer to purchase merchandise, you expressly authorized us to perform credit checks and, where Mimiamo feels necessary, to transmit or to obtain your credit card information or credit report information (including any updated information) to or from third parties solely to authenticate your identity, to validate your credit/debit card, to obtain an initial credit card authorization and/or to authorize individual purchase transactions.

Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

4. ORDERS

All orders are subject to acceptance and availability, and Items in your shopping basket are not reserved and may be purchased by other customers. Mimiamo offers products for sale that are in stock and available for dispatch from our distribution center. You may choose to register your email address for notification of arrival of the selected merchandise not held in stock.

If you have registered your email address for notification of the arrival of a specific product featured on our Site, we will attempt to notify you by email within 48 hours of the product becoming available on the Site. Please note that on occasion certain products that are in particularly high demand will sell out during this period.

Mimiamo will store a record of your transactions for a minimum of one year.

5. PRICING POLICY

In the case of product delivery to a country associated with the US dollar or other currencies outside of the Republic of Korea, customs taxes and formalities are the sole responsibility of the Customer, unless otherwise stated. The Customer thus undertakes to check the possibility of importing the products ordered to the delivery country. Delivery is therefore on a DTN (Duties & Taxes Now) basis. The recipient will be obliged to pay all the import or local taxes applicable to his/her order. 

However customer may choose DTD (Duties & Taxes upon Delivery) and prices shown on the Site will be exclusive of taxes and import duty. Import duty or tax costs will be invoiced to you directly from FEDEX or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.

If you are a customer whose credit/debit card is not denominated in Korean won(KRW), the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted.

6. ACCEPTANCE OF YOUR ORDER

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.

Unless you cancel your order, acceptance of your order will be perfected upon completion of the packing of your order. Completion of the contract between you and Mimiamo will be perfected when we dispatch the goods to you at which time you will receive a second email containing you tracking number, and confirming that your order has been dispatched. The sale contract is therefore concluded in the Federal Law of Republic of Korea, and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of Mimiamo.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set-out within the Terms and Conditions.

Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

7. PAYMENT

Payment can be made by Visa, MasterCard, American Express, and any other methods which may be clearly advertised on the site from time to time. You can also choose to pay with PayPal. When selecting this option at checkout, you will be directed to the PayPal site to 'Log In' and review the amount shown before clicking 'Pay Now'. Once this transaction is complete, you will then return to Mimiamo. Payment will be debited and cleared from your account upon completion of the packing of your order by Mimiamo. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer.

If the issuer of your credit/debit card refuses to authorize payment to Mimiamo, we will not be liable for any delay or non-delivery. Occasionally, high demand causes us to run out of certain items. If we don't have an item that you have ordered in stock, we'll notify you by email immediately.

Sometimes, an item is out of stock and not expected to come back in stock, so we must cancel the item. In this case, if you paid with a credit/debit card, we will not charge you for the item or any taxes, shipping or handling charges.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using 2Checkout, a secure online payment gateway that encrypts your card details in a secure host environment. If you are a registered Mimiamo user, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

8. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION ON THIS SITE

Mimiamo is not responsible if information made available on this Site is not accurate, complete or current. The material on this Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this Site is at your own risk. We reserve the right to modify the content of this Site at any time, but we have no obligation to update any information on the Site. You agree that it is your responsibility to monitor changes to the Site. Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be represented at a larger than actual size in order to clearly show details, or smaller than actual size in order to show the entire item.

9. THIRD PARTY

Certain of the content, features, hyperlinks and functionality on the Site may be owned and operated by third parties (collectively, “Third Party Providers”), including advertisers. Your use of and interaction with such content, features and functionality (collectively, “Third Party Content”) may be subject to separate terms and conditions. In that event, you acknowledge that these Terms and Conditions will not apply to your use of the Third Party Content and that you will be subject to and comply with the terms of use offered by such Third Party Providers. 

YOU ACKNOWLEDGE THAT WE ARE NOT RESPONSIBLE OR OTHERWISE LIABLE FOR THIRD PARTY CONTENT OR THE ACTS OR OMISSIONS OF THIRD PARTY PROVIDERS AND THAT ANY CLAIMS OR OTHER CAUSES OF ACTION AVAILABLE TO YOU IN CONNECTION WITH EITHER OF THE FOREGOING WILL BE BROUGHT AGAINST THE APPLICABLE THIRD PARTY PROVIDER(S) AND NOT US.

10. INSURANCE AND DELIVERY

(1) Insurance

You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) before shipment is ready for shipment

Mimiamo insures each purchase during the time it is in transit before it is shipped. Mimiamo does not accept returns on any orders shipped to addresses outside of the Republic of Korea. All purchases shipped outside of the Republic of Korea are Final Sale. Once shipped, international orders cannot be cancelled. Special orders cannot be cancelled. Refused international shipments will be abandoned and will not be refunded.

In case of damage, the Customer specifies and clarifies its reservations on the delivery note, a copy of which is sent by post or by carrier to the Company. In this respect, it is up to the Customer to check the contents, compliance and condition of the product upon delivery. This check is deemed to have occurred when the Customer, or a person duly authorized by him/her, signs the delivery note presented by the postal worker or by the carrier.

Despite the care taken in the preparation of orders, it is possible that a product may be missing, or that an error may occur during the preparation. If you encounter such an error, please report it by email to customerservice@mimiamo.com within a maximum of 48 hours of receiving the order.

(2) Delivery

Please note that we aim to dispatch all orders within 24 hours, or 48 hours during sale periods. Delivery times appearing on the Site are estimates and are to be used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order. Mimiamo is not responsible for any delays caused by destination customs clearance processes.

The delivery time depends on the delivery address as well as the delivery method chosen by the Customer. If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact Fedex.

(3) Shipping

The Website delivers throughout the world (see list of countries where we deliver our products). The ordered product is delivered to the address which appears on the Customer’s purchase order. 

International delivery (outside Republic of Korea) must be performed by Fedex.

Fedex: Delivery within 3 to 6 business days

Shipping is free of charge for deliveries above for USD 500 for international deliveries.

11. RETURNS AND EXCHANGES 

FOR INTERNATIONAL SHIPMENTS- ORDERS SHIPPED OUTSIDE OF REPUBLIC OF KOREA

Sales on this Site are subject to our Return Policy.

You can cancel your order before final shipment is prepared.

Mimiamo does not accept returns on any orders shipped to addresses outside of the Republic of Korea. All purchases shipped outside of the Republic of Korea are Final Sale. Once shipped, international orders cannot be cancelled. Special orders cannot be cancelled. Refused international shipments will be abandoned and will not be refunded.

REPEATED CANCEL

We do monitor the number of cancel made by customers, and continued cancel will be flagged and potentially refused at our discretion or lead to the closure of your Mimiamo account.

12. USE OF MATERIALS ON THE SITE

All content on this Site (including, without limitation, text, design, graphics, logos, icons, images, audio clips, downloads, interfaces, code and software, as well as the selection and arrangement thereof), is the exclusive property of and owned by Mimiamo, its licensors or its content providers and is protected by copyright, trademark and other applicable laws. You may access, copy, download and print the material contained on the Site for your personal and non-commercial use, provided you do not modify or delete any copyright, trademark or other proprietary notice that appears on the material you access, copy, download or print. Any other use of content on the Site, including but not limited to the modification, distribution, transmission, performance, broadcast, publication, uploading, licensing, reverse engineering, transfer or sale of, or the creation of derivative works from, any material, information, software, products or services obtained from the Site, or use of the Site for purposes competitive to Mimiamo, is expressly prohibited. You agree to abide by all additional restrictions displayed on the Site as it may be updated from time to time. Mimiamo reserves the right to refuse or cancel any person’s registration for this Site, remove any person from this Site or prohibit any person from using this Site for any reason whatsoever. Mimiamo, or its licensors or content providers, retain full and complete title to the material provided on the Site, including all associated intellectual property rights, and provide this material to you under a license that is revocable at any time in Mimiamo’s sole discretion. Mimiamo neither warrants nor represents that your use of materials on this Site will not infringe rights of third parties not affiliated with Mimiamo.

You may not use contact information provided on the Site for unauthorized purposes, including marketing. You may not use any hardware or software intended to damage or interfere with the proper working of the Site or to surreptitiously intercept any system, data or personal information from the Site. You agree not to interrupt or attempt to interrupt the operation of the Site in any way. Mimiamo reserves the right, in its sole discretion, to limit or terminate your access to or use of the Site at any time without notice. Termination of your access or use will not waive or affect any other right or relief to which Mimiamo may be entitled at law or in equity.

13. MATERIALS YOU SUBMIT

You acknowledge that you are responsible for any material you may submit via the Site, including the legality, reliability, appropriateness, originality and copyright of any such material. You may not upload to, distribute or otherwise publish through this Site any content that (i) is confidential, proprietary, false, fraudulent, libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, infringing on intellectual property rights, abusive, illegal or otherwise objectionable; (ii) may constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability or violate any law; or (iii) may contain software viruses, political campaigning, chain letters, mass mailings, or any form of “spam.” You may not use a false email address or other identifying information, impersonate any person or entity or otherwise mislead as to the origin of any content. You may not upload commercial content onto the Site.

If you do submit material, and unless we indicate otherwise, you grant Mimiamo and its affiliates an unrestricted, nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such material throughout the world in any media. You further agree that Mimiamo is free to use any ideas, concepts, know-how that you or individuals acting on your behalf provide to Mimiamo. You grant Mimiamo and its affiliates the right to use the name you submit in connection with such material, if they so choose. You represent and warrant that you own or otherwise control all the rights to the content you post; that the content is accurate; that use of the content you supply does not violate any provision herein and will not cause injury to any person or entity; and that you will indemnify Mimiamo for all claims resulting from content you supply.

14. CONDUCT ON THE SITE

Some features on this Site may require registration. By registering at and in consideration of your use of the Site you agree to provide true, accurate, current and complete information about yourself.

Some features on this Site may require use of a password. You are responsible for protecting your password. You agree that you will be responsible for any and all statements made, and acts or omissions that occur, through the use of your password. If you have any reason to believe or become aware of any loss, theft or unauthorized use of your password, notify Mimiamo immediately. Mimiamo may assume that any communications Mimiamo receives under your password have been made by you unless Mimiamo receives notice otherwise.

You or third parties acting on your behalf are not allowed to frame this Site or use our proprietary marks as meta tags, without our written consent. Further, you may not utilize any Site content in any meta tags or any other “hidden text” techniques or technologies without Mimiamo’s express written consent.

15. LINKS

This Site may contain links to other websites, some of which are operated by Mimiamo or its affiliates and others of which are operated by third parties. These links are provided as a convenience to you and as an additional avenue of access to the information contained therein. We have not necessarily reviewed all the information on those other sites and are not responsible for the content of those or any other sites or any products or services that may be offered through those or any other sites. Inclusion of links to other sites should not be viewed as an endorsement of the content of linked sites. Different terms and conditions may apply to your use of any linked sites. Mimiamo is not responsible for any losses, damages or other liabilities incurred as a result of your use of any linked sites.

16. TRADEMARKS AND COPYRIGHTS

Trademarks, logos and service marks displayed on this Site, including those identified at /policy are registered and unregistered trademarks of Mimiamo, its licensors or content providers, or other third parties. All of these trademarks, logos and service marks are the property of their respective owners. Nothing on this Site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the Site without the owner’s prior written permission, except as otherwise described herein. Mimiamo reserves all rights not expressly granted in and to the Site and its content. This Site and all of its content, including but not limited to text, design, graphics, interfaces and code, and the selection and arrangement thereof, is protected as a compilation under the copyright laws of Republic of Korea and other countries.

17. INTELLECTUAL PROPERTY

Unless otherwise stated, all intellectual property rights, (including but not limited to copyright, trade marks, registered and unregistered designs, database rights, domain names and goodwill (“Intellectual Property Rights”)) in all content included on this Site and, including all text, graphics, logos, photographs and images) is the exclusive property of Mimiamo or its licensors and is protected by applicable legislation around the world. Any commercial use, including the reproduction, modification, distribution and transmission of any content is strictly prohibited without the consent of Mimiamo Co., Ltd.

18. LAW & JURISDICTION

These Terms are governed by and construed in accordance with Republic of Korea law and subject to the exclusive jurisdiction of the Federal Courts.

19. CHANGES TO THESE TERMS AND CONDITIONS

Mimiamo reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms and Conditions, in whole or in part, at any time, by posting revised terms on the Site. It is your responsibility to check periodically for any changes we make to the Terms and Conditions. Your continued use of the Site after any changes to the Terms and Conditions or other policies means you accept the changes.

In the event we make material changes to the Terms and Conditions, notice of the changes will be posted on the homepage of this Website and the revised terms will take effect thirty days after their publication on the Site.

20. ENTIRE AGREEMENT AND ADMISSIBILITY

This agreement and any policies or operating rules posted on this Site constitute the entire agreement and understanding between you and Mimiamo with respect to the subject matter thereof and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. A printed version of these Terms of Use shall be admissible in judicial or administrative proceedings based on or relating to use of the Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

21. SEVERABILITY

If any of the terms within these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
